Bidding Terms & Conditions for DXB24 ART

1. Introduction

By participating in auctions on DXB24 ART, you agree to abide by these Bidding Terms & Conditions. These terms govern your use of the platform, including bidding, payment, and disputes. Please read them carefully before placing a bid.

2. Fees and Payment

  1. Pricing Structure:

    • All bids placed on DXB24 ART are final and binding. By placing a bid, you agree to pay the full amount of your winning bid, plus any applicable fees (e.g., buyer’s premium, taxes, shipping).

  2. Payment Terms:

    • Payment is due immediately upon winning an auction. Invoices will be issued electronically to the email address provided during registration.

    • Accepted payment methods include credit/debit cards, PayPal, and bank transfers.

  3. Additional Charges:

    • Buyers are responsible for shipping costs, customs duties, and any other fees associated with the delivery of artwork.

3. Bidding Process

  1. Bid Placement:

    • Bids must follow the specified bidding increments for each auction. DXB24 ART reserves the right to reject bids that do not comply.

    • By placing a bid, you confirm that you are legally able to enter into a binding contract and have the financial means to pay for the artwork if you win.

  2. Reserve Price:

    • Some auctions may have a reserve price (the minimum price the seller is willing to accept). If the reserve price is not met, the artwork will not be sold.

  3. Winning Bids:

    • The highest bidder at the close of the auction is the winner. DXB24 ART will notify the winner via email and issue an invoice.

4. Termination and Cancellation

  1. Bid Retraction:

    • Bids cannot be retracted once placed, except in cases of clear typographical errors. To request a bid retraction, contact DXB24 ART support within 1 hour of placing the bid.

  2. Auction Cancellation:

    • DXB24 ART reserves the right to cancel an auction at any time due to unforeseen circumstances (e.g., seller withdrawal, technical issues). In such cases, all bids will be voided, and participants will be notified.

5. Liability and Indemnification

  1. DXB24 ART’s Liability:

    • DXB24 ART acts as an intermediary between buyers and sellers. We are not responsible for the authenticity, condition, or legality of the artwork listed on our platform.

    • DXB24 ART is not liable for any damages, losses, or disputes arising from the use of our platform.

  2. Buyer’s Responsibility:

    • Buyers are responsible for verifying the authenticity and condition of artwork before placing a bid. DXB24 ART encourages buyers to request additional information or condition reports from sellers.

  3. Indemnification:

    • By using DXB24 ART, you agree to indemnify and hold DXB24 ART harmless from any claims, damages, or losses arising from your use of the platform.

6. Governing Law and Jurisdiction

  1. Governing Law:

    • These terms and conditions are governed by the laws of the United Arab Emirates.

  2. Dispute Resolution:

    • Any disputes arising from these terms or your use of DXB24 ART will be resolved through arbitration in Dubai, UAE, in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

Buying Auction Terms & Conditions for DXB24 ART

    • To participate in auctions, buyers must register an account on DXB24 ART and provide accurate information.

    • DXB24 ART reserves the right to reject or suspend accounts at its discretion.

  2. Bidding:

    • By placing a bid, you confirm that you are legally able to enter into a binding contract and have the financial means to pay for the artwork if you win.

2. Auction Process

  1. Bidding Increments:

    • Bids must follow the specified bidding increments for each auction. DXB24 ART reserves the right to reject bids that do not comply.

  2. Reserve Price:

    • Some auctions may have a reserve price (the minimum price the seller is willing to accept). If the reserve price is not met, the artwork will not be sold.

  3. Winning Bids:

    • The highest bidder at the close of the auction is the winner. DXB24 ART will notify the winner via email and issue an invoice.

3. Payment and Shipping

  1. Payment:

    • Payment is due immediately upon winning an auction. Failure to pay may result in account suspension or legal action.

  2. Shipping:

    • Buyers are responsible for arranging and paying for shipping. DXB24 ART can provide recommendations for trusted shipping partners upon request.

4. Returns and Disputes

  1. Returns:

    • All sales are final. Returns are only accepted if the artwork is significantly different from its description or is damaged during shipping.

  2. Disputes:

    • Any disputes regarding the condition or authenticity of artwork must be reported to DXB24 ART within 7 days of receipt. DXB24 ART will mediate between the buyer and seller to resolve the issue.

5. Governing Law and Jurisdiction

    • These terms and conditions are governed by the laws of the United Arab Emirates.
